Limited Assistance Representation

Some people find that the cost of full-service representation is prohibitive. Others want to retain control over their cases and turn to an attorney to coach them or assist in completing their paperwork. They prefer to retain primary control over their legal matters and appear in court themselves.

Cases like child custody settlement or division of pension benefits can be quite complex and technical. Some others are relatively straightforward. In those cases, the attorney may assist the client and perhaps even appear in court on the more difficult aspects. The attorney may also coach the client and explain the court’s procedures before they go to court on their own on the simpler issues.

Limited assistance representation (LAR) lets you hire an attorney to help you with only those parts of your case where you need legal help and advice. Aside from saving money, this also gives you the control you want throughout the divorce.

LAR encompasses a range of attorney–client relationships. The attorney handles part, but not all, of a legal matter. It can include:
  • Rendering advice and counsel or “coaching”
  • Assistance with drafting of court documents or “ghostwriting”
  • Attorney appearance in court on a limited basis for part of a legal proceeding

Understanding Child Support Obligations

Few people suggest that raising children is easy. Children need time, emotional investment, and significant financial requirements. Health insurance for children can be expensive. If parents are self-employed, finding an affordable coverage can be challenging. Paying for college is another challenge. Child support payments may be extended until the child reaches the age of 23 or until the child finishes his or her undergraduate degree.

Moniz Law & Mediation, PC helps clients understand parent’s financial obligations. Most child support issues are resolved by the application of the Massachusetts Child Support Guidelines. These provide a formula that determines a weekly child support obligation. The amount is calculated based on the parent’s gross income and number of children. The cost of health insurance, day care and any previous child support obligations are also taken into consideration.
